Rental Terms and Conditions

We at On Yer Bike Winery Tours will do everything to make sure your rental experience is a success and that you will have a great time. In order to ensure that you know exactly what our (and your) responsibilities are, please read the following rental terms and conditions.

Rates, duration and late returns.

You agree to pay current daily rental rate as printed on this website, plus any additional fees that may applicable.

Stated rates may be subject to change without notice until full payment has been made and confirmation provided. All prices quoted are in New Zealand dollars and include GST.

When you book a bike through this website you agree to and confirm the date and start time:

  • Hire slots begin at 10 am, 11 am, or 12 pm.

  • Please arrive on time at your allotted booking.

  • We will not accept pre-booked hires after 12:30pm.

If you turn up later than your allotted booking time, you will still be expected to pay the full sum you agreed at booking. You will not be forwarded a cheaper price because you turned up an hour late. Consequently if you have booked a time an turn up more than 30 minutes early, you may be charged the amount for an earlier booking.

All hires are to be returned on or before 5:00pm on the day of hire.

If you fail to return the equipment on or before 5pm on the day of hire,  On Yer Bike Hawkes Bay Ltd reserves the right to charge an additional penalty fee of $5 per half-hour per bike, or part thereof, to them for any unauthorized extension of their hire  in addition to the current daily rental rate. You will agree that On Yer Bike Hawkes Bay Ltd reserves the right to seek reparation of additional penalty fees from the person who initially made the booking and paid the deposit, if not settled by the renter when returning the equipment.

Equipment Use & Responsibility.

We ask that you inspect and check the equipment presented to you. Any changes and alterations can be done at this point. Once accepted, you confirm the equipment was given to you in good condition.  You agree to operate it in a responsible manner which, at all times, remains the exclusive property of On Yer Bike Hawke’s Bay Ltd. You are fully responsible for its care whilst in your possession.

  1. You will ride only on tarmac or gravel cycle trails. No riding on off-road tracks, through rivers, waterways, or flooded paths.
  2. You will not use the bike for racing, stunts, jumps, tricks, or wheelies, or brake in a way that locks the wheels (skids).
  3. Any damage you cause to the bicycle will be charged according to OYB’s published repair cost schedule.
  4. Not to ride the bicycle in a manner that may endanger the rider or other persons or road users.
  5. The renter is personally responsible for any traffic infringements occurring while they have the bike for hire.
  6. You will secure the bike when unattended. Lost bikes will incur a replacement fee (approx. $2,500 for e-bikes, $950 for standard bikes).  Lost padlocks or helmets will incur a $25 replacement fee each.
  7. You commit to return the bike in equally good condition, and to ride the bike respecting the rules and obligations outlined in the Land Transport Act 1998.

Maintenance, Damage and Repairs

Our commitment is to ensure that you receive equipment in a good working order. We do accept that, through wear and tear, small things may go wrong. For instance, if the bike suffers a puncture or someting breaks, through no fault of your own, don’t abandon the bicycle. Contact us immediately to arrange for the exchange of a replacement bicycle.  We will endeavor to fix or replace the bike at the earliest convenience.

If however, the bike suffers damage due to an accident or mishandling at your hand – and yes, we can tell the difference – we will collect the bicycle and immediately terminate the hire agreement. In the hire agreement, you  have agreed to pay for any damages incurred to the bicycle due to mistreatment or an accident. The charges will be as follows:

Note: Damages are charged per actual cost; labour is $50/hour. Deliberate misuse may incur full replacement costs.

Health and Safety

By hiring and using a bicycle, you accept that you are voluntarily participating in this activity and are fully aware of the risks associated with riding a bicycle. You confirm you are able to competently ride a bicycle.
a. You agree to follow all NZ road rules, including wearing a helmet, keeping left, and obeying road signs.
b. You will not ride under the influence of drugs or alcohol.
c. You will report any accident, damage, theft, or incident to OYB immediately.

Insurance.

We cannot be held responsible for any illness or injury or for damage or loss of personal belongings when you rent equipment from us. We recommend that you are adequately insured for these outcomes.

Visitors to New Zealand must have full insurance due to limited ACC cover.

Liability Waiver & Indemnity

You agree to release and discharge OYB, its staff, agents, and representatives from all liability for any injury, loss, or damage (including negligence) arising directly or indirectly from hiring and riding a bike from OYB. I agree to indemnify and hold them harmless from any third-party claims resulting from you actions while riding.

Termination of Hire

On Yer Bike Hawke’s Bay Ltd reserves the right to terminate you hire at any point, but particularly if any of the following occurrences happen:

  1. Ride the bicycle in a manner that puts yourself or other members of the public in danger.
  2. Damage the bike to the point that it is no longer ridable.
  3. Are found to be intoxicated, or are seen drinking alcohol whist riding a bicycle.

Abandonment

If you abandon your bicycle during your hire or decide you can no longer ride, and we have to come and collect your bike. We will charge a recovery fee of $50 per bicycle to do so.

Once a hire has started no refunds will be entertained.

Partial attendance

In the case of parties or groups that have booked in excess of their attended numbers, any bicycles booked but not taken, On Yer Bike Hawke’s Bay Ltd, reserves the right to retain any monies paid. We do not give refunds on the day. Please read our full refunds and cancellation policy page.

If you have booked and paid for bicycles, and you or one of your group intends to use your/their own bicycle and helmet, we will charge the full daily hire rate amount as if you/they had taken one of our bicycles and helmets.

Use of own bicycle with a group.

If you have booked a group of people to use our bicycles for a winery tour and additional people wish to join your group on their own bikes, we may refuse the following services:

  1. If the number of private bikes exceeds 20% (more than one private bikes for every five bikes hired) of the booked number of bikes, we will not offer the wine collection service to your group. Wine collection is an individual perk of a renter and is not available or extended to people who bring their own bikes. As we cannot monitor who is whom, wine collection will be revoked from the entire group.

Private Parking

On Yer Bike Hawkes Bay Ltd has plenty of parking. Vehicles are left at the owner’s risk and Ash Ridge Wines Ltd or On Yer Bike Hawkes Bay Ltd will not be liable for any damage or loss arising from leaving your property at Ash Ridge Wines.

Vehicles may be left overnight once permission has been sought. Access will be between 10am and 4pm to retreive any vehicles left. We do not allow overnight parking on the eve of a public holiday. 

Any unauthorized vehicle will be removed by whatever means possible at vehicle owners expense.

Confirmation of acceptance of these terms.

By signing our standard hireage agreement at the commencement of hire the renter is acknowledging that they have read the terms and conditions, they fully understand its content and that these terms and conditions cannot be modified orally, and they agree to be bound by them.
